Alternative to Clean Power Plan

The Supreme Court’s provisional stay of the Clean Power Plan has raised questions about the design and legal foundation of the United States national climate commitment. In an interview with NPR’s Living on Earth podcast, Michael Burger—Executive Director of Columbia University’s Sabin Center for Climate Change Law—described Section 115 of the Clean Air Act as designed “to allow the executive branch to cooperate with foreign countries to solve international air pollution problems.”  He believes that “Section 115 authorizes EPA to, in effect, invoke a nationwide, economy-wide, cross-sectorial, market-based mechanism to deal with climate change” such as a cap-and-trade system or even state-level carbon taxes. Enhancing NDCs at the ‘Action COP’

The COP22, to be held in November, in Marrakech, has been labeled “the Action COP” by a number of leading diplomats and negotiators. Speculation about the full Entry-into-Force start-date for the Paris Agreement puts the possible date as early as May 2017. Throughout 2016, governments will be exploring ways to implement, enhance, or accelerate their Nationally Determined Contributions, possibly to capture subsidies, new investment, or early actor market-share. We will be tracking these changes and enhancements, and publishing information about the easiest and most cost-effective ways to do so.

Canada calls on provinces to form working groups to accelerate climate action

The federal government of Canada, under the leadership of Prime Minister Justin Trudeau, is calling on provincial governments to join four working groups to enhance and accelerate climate action. The four working groups will be:

  • Clean technology and innovation
  • Carbon pricing
  • Mitigation (reducing GHG emissions)
  • Adaptation

The federal government has said it will set a national carbon price policy—possibly a uniform minimum carbon price, allowing existing provincial carbon pricing policies to be the vehicle for meeting a national standard. With Ontario’s new plan underway, 75% of Canadians now live in a jurisdiction with some form of carbon pricing.

Mission Focus

The NDC-Tracking Workstream began as discussions in Pathway to Paris working sessions focused on the strengths and weaknesses of proposed Intended Nationally Determined Contributions to the global climate accord to be agreed during the COP21 in Paris. After Paris, the INDCs should transition to being active Nationally Determined Contributions to global climate action.
